These are our detailed policies regarding volunteers for PDM PRODUCTIONS, INC. These policies cover the definition of a volunteer, confidentiality, copyright issues, when additional screening is necessary, inappropriate communications, when volunteers can represent PDM PRODUCTIONS, INC., online safety, ending your role as a volunteer with PDM PRODUCTIONS, INC. (or any specific projects), and dismissal of a volunteer.
PURPOSE OF VOLUNTEER POLICIES
These policies are written to provide overall guidance and direction to staff and volunteers engaged in volunteer involvement and management efforts. These policies do not constitute, either implicitly or explicitly, a binding contractual or personnel agreement. PDM PRODUCTIONS, INC. reserves the exclusive right to change any of these policies at any time and to expect adherence to the changed policy. Changes to or exceptions from these policies may be granted by a majority decision of the Board of Directors, and must be obtained in advance in writing. Areas not specifically covered by these policies shall be determined by a member of the Board of Directors or the Volunteer Program Manager.
DEFINITION OF ‘VOLUNTEER’
A volunteer is anyone who, without compensation or expectation of compensation beyond reimbursement, performs a task at the direction of and on behalf of this organization (PDM PRODUCTIONS, INC.). a “volunteer” must be officially accepted and enrolled by PDM PRODUCTIONS, INC. prior to performance to the task. Unless specifically stated, volunteers shall not be considered as “employees” of PDM PRODUCTIONS, INC.
PDM PRODUCTIONS, INC. also accepts as volunteers those in student community service activities, student intern projects, alternative sentencing of diversion programs, corporate volunteer programs, and other volunteer referral programs. In each of these cases, however, a written agreement must be in effect with the organization, school, or program from whom the special case volunteers originate and this agreement must identify responsibility for management and care of the volunteers. This agreement must be reached in writing before the volunteer begins, especially if it’s an online assignment.
SERVICE AT THE DISCRETION OF THE ORGANIZATION
PDM PRODUCTIONS, INC. accepts the service of all volunteers with the understanding that such service is at the sole discretion of the PDM PRODUCTIONS, INC. Volunteers agree that we may at any time, for any reason, decide to terminate the volunteer’s relationship with PDM PRODUCTIONS, INC. The volunteer may at any time, for whatever reason, decide to sever their relationship with PDM PRODUCTIONS, INC. Notice of such a decision should be communicated as soon as possible to all necessary personnel and supervisors.
VOLUNTEERS UNDER 18
If you are under 18, please let at least one of your parents know you are going to volunteer. We strongly suggest that you give your parents the contact information and any other information that you have received, or seen online, so they may read through the materials themselves, and contact us at any time. It is suggested that you also copy your parents to any communications regarding anything pertaining to PDM Productions.
REPRESENTING PDM PRODUCTIONS, INC.
As a volunteer, you represent PDM Production, Inc and its Mission. Volunteers are authorized to act as representatives of PDM PRODUCTIONS, INC. as specifically indicated within their job descriptions and only to the extent of such written specifications. Volunteers are asked to not contact organizations or individuals on behalf of PDM PRODUCTIONS, INC. unless they are given express written directions to do so by one of the Directors or Managers. Prior to any action or statement, which might significantly affect or obligate PDM PRODUCTIONS, INC., volunteers should seek prior consultation and approval from appropriate staff. These actions may include, but are not limited to, public statements to the press, coalition or lobbying efforts with other organizations, or any agreements involving contractual or other financial obligations.
Volunteers are responsible for maintaining confidentiality of all proprietary or privileged information to which they are exposed while serving as a volunteer, whether this information involves a single staff, volunteer, client, or other person or involves overall business. Failure to maintain confidentiality may result in termination of the relationship with PDM PRODUCTIONS, INC., or other corrective action.
SCREENING / REFERENCE CHECKS
For some tasks, volunteers must submit samples of work and professional references. If such is required, it will be outlined in the task description. Volunteers, by agreeing to apply to be a volunteer, will have their names submitted for a criminal background check. In some cases, also drug screening.
COPYRIGHT / OWNERSHIP ISSUES
I grant non-exclusive permission to PDM PRODUCTIONS, INC. for use of any materials produced for PDM PRODUCTIONS, INC. including graphics material, web page designs, narratives, research, compilations, instructional texts, etc., becomes the property of PDM PRODUCTIONS, INC. upon submission. Volunteers will receive credit on PDM PRODUCTIONS, INC. website and any other necessary materials which might communicate such for these contributions.
CONTACTING OTHER VOLUNTEERS
Occasionally, volunteers will need to contact other volunteers with regard to their activities with PDM PRODUCTIONS, INC. We expect all such communications among volunteers to follow etiquette guidelines. Other than email addresses, PDM PRODUCTIONS, INC. will not share contact information about a volunteer without the express consent of all parties involved. We encourage volunteers to use common sense when communicating with other volunteers, or anyone, especially online. We suggest following this rule: Don’t reveal anything about yourself online, or anywhere, to someone that you would not feel comfortable revealing to a stranger you just met on the street.
If at any point you receive a communication of any kind that you feel is inappropriate, for any reason, and you believe you have received it in conjunction with your involvement with PDM PRODUCTIONS, INC., please forward the communication, along with any other details, to the Directors of PDM PRODUCTIONS, INC.
The safety of our volunteers is important to us. To that end, PDM PRODUCTIONS, INC. will not release a volunteer’s phone number, age, or other personal information to anyone outside of the organization, or to other volunteers, without the volunteer’s written permission to do so. We will list volunteers who have completed assignments for us. We will, at the volunteer’s request, list where they reside along with their email address. PDM PRODUCTIONS, INC. will not be responsible for any unwarranted solicitations received by the volunteer if we include their email address.
PDM PRODUCTIONS, INC. expects all volunteers to update their virus software on a regular basis. This is not only for our protection, but yours. Likewise, PDM PRODUCTIONS, INC. has anti-virus software, and updates it quarterly, if not bi-monthly. Computer virus protection for your computer is your responsibility.
DISMISSAL OF A VOLUNTEER
Volunteers who do not adhere to the rules and procedures of PDM PRODUCTIONS, INC. or who fail to satisfactorily perform their volunteer assignment are subject to dismissal. No volunteer will be terminated until the volunteer has had an opportunity to discuss the reasons for possible dismissal with supervisory staff. Possible grounds for dismissal may include, but are not limited to, the following: gross misconduct or insubordination, theft of property or misuse of the organizations materials, abuse or mistreatment of clients, students, staff, or other volunteers, failure to abide by PDM PRODUCTIONS, INC. policies and procedures, and failure to satisfactorily perform assigned duties

I acknowledge that I have read and understand the above written volunteer code of conduct agreement. I agree to adhere to the required guidelines and understand that this is an “at will” agreement. I also understand that I may be terminated by PDM PRODUCTIONS, INC., and that I may also terminate this agreement at any time, for any reason, with or without cause.
Volunteer Waiver, Release & Indemnity Agreement
This document sets forth the responsibilities and understandings of the volunteer and PDM PRODUCTIONS, INC. regarding the volunteer’s participation as an “at will” volunteer in programs partially or wholly coordinated by PDM PRODUCTIONS, INC.
The volunteer and PDM PRODUCTIONS, INC. agrees as follows:
The volunteer performs the services of the volunteer’s own free will, without promise, expectation, or receipt of remuneration. The volunteer is not an employee or agent of PDM PRODUCTIONS, INC. for any purpose and the volunteer’s services are not controlled nor mandated by PDM PRODUCTIONS, INC.
If the volunteer is under the age of 18, the volunteer may only participate in volunteer service with the express written consent of the parent or guardian.
The volunteer understands and agrees that is possible that the volunteer may be injure or otherwise harmed during volunteer service due to accidents, acts of nature, the volunteers negligent or intentional acts, or the negligent or intentional acts of others; that while PDM PRODUCTIONS, INC. has taken some steps to reduce the chances of injuries or harm to the volunteer, PDM PRODUCTIONS, INC. has no control over most risk, and thus, cannot and does not guarantee nor take and responsibility for the safety of the volunteer or the volunteer’s property while engaged in volunteer service. The volunteer must take full responsibility for himself or herself and assume the risk of harm or damage while serving, by taking all necessary and reasonable precautions and acting in a manner that will help protect himself or herself and his or her property.
The volunteer agrees to waive and release PDM PRODUCTIONS, INC. form any and all potential claims for injury, illness, damage, or death which the volunteer may have against PDM PRODUCTIONS, INC. that might arise out of the volunteer’s service and to hold PDM PRODUCTIONS, INC. harmless there from.
The volunteer agrees and understands that injuries or losses to others, such as co-workers or the person(s) being helped, may occur as a result of the volunteer’s negligent or intentional acts during volunteer service, and that to avoid such harm, the volunteer must exercise care and act responsibly in serving others.
If any injury or loss does occur due to the volunteer’s intentional or negligent actions arising outside of the scope of the volunteer’s activities, the volunteer must accept the liability for and repair, or make reparations for, the harm done.
PDM PRODUCTIONS, INC. is not providing the volunteer with insurance coverage for any injuries, conditions, or losses to the volunteer arising out of volunteer activities, except that PDM PRODUCTIONS, INC. does provide liability insurance coverage on all vehicles used during and for service projects related to PDM PRODUCTIONS, INC. activities.
In projects where the volunteer will be transporting others in a non-PDM PRODUCTIONS, INC. owned vehicle, the volunteer may be asked to provide proof of automobile insurance in order to participate.
Since volunteers are not PDM PRODUCTIONS, INC. employees, PDM PRODUCTIONS, INC. does not provide workers compensation coverage for injuries or illnesses arising out of any volunteer activities.
The volunteer must maintain his or her own medical insurance and automobile liability insurance to cover potential medical and other costs related to the volunteer service; and the volunteer is also encouraged to maintain property and like insurance coverage while serving as a volunteer for PDM PRODUCTIONS, INC. or any organization.
All costs for injury or loss above the coverage provided by the volunteer’s insurance are the volunteer’s personal responsibility.
PDM PRODUCTIONS, INC. will provide the volunteer with a legal defense, upon request, in response to any claim or action brought against the volunteer, arising out of the volunteer’s volunteer service in a program the PDM PRODUCTIONS, INC. HELPS COORDINATE, where the volunteer was acting in good faith and reasonably believed you were acting within the scope of the volunteer activity, and the act in question was not an intentional or knowing act constituting illegal, willful, or wanton misconduct. However, PDM PRODUCTIONS, INC. will not defend the volunteer in any case where the injury resulted from the operations of a non-PDM PRODUCTIONS, INC. motor vehicle, vessel, or any other vehicle for which an operator’s or pilots license is required or where the suite is brought by an authorized governmental officer to enforce a federal, state, or local law
In the event of any legal actions in which PDM PRODUCTIONS, INC. provides the volunteer’s defense, PDM PRODUCTIONS, INC. will pay for reasonable attorney fees, judgements, settlements, or other expenses related to the volunteer’s defense, only up to the limits presently stated in the appropriate State statutes, one time only (per volunteer). PDM PRODUCTIONS, INC. will control the defense and the volunteer must reasonably cooperate and comply with PDM PRODUCTIONS, INC. decisions and procedures.

COVID-19 Waiver & Release
Coronavirus (COVID-19) has been declared a worldwide pandemic by the World Health Organization. In response, PDM Productions, Inc. has established health and safety policies and protocols to try to minimize the spread of COVID-19. PDM Productions, Inc. has also established screening procedures for employees and dancers, which must be followed each time an individual enters the studio building.
PDM Productions Inc. Inc is committed to providing a safe and healthy environment for its employees, dancers, and other guests. As a result, PDM Productions Inc has implemented the foregoing policies and procedures, which are subject to change based on government guidance. Although preventive measures are in place and will be adhered to, given the novel nature of COVID-19 and the rapid pace at which it spreads, PDM Productions Inc. cannot guarantee that you, your child (the “Dancer”), or your family members will not be exposed to or become infected with coronavirus. By accessing the rehearsal and performance buildings and attending the rehearsals and performances, you may be putting yourself, your child, and others at increased risk for contracting coronavirus.
By checking the circle below, you understand, acknowledge, and agree to the following:
You assume the risk that you, your child, or your family members may be exposed to or become infected with coronavirus and that such exposure and/or infection may result in death; personal injury; illness, causing mild symptoms such as, fever or body aches, or more severe complications, such as pneumonia or organ failure; or permanent disability; and
You understand that the risk of exposure to or infection with coronavirus may result from the acts, omissions, or negligence of PDM Productions Inc., Prestige Dance Studio, or Manchester High School or others, including but not limited to, the faculty, staff, volunteers, guests of PDM Productions, Inc, and program participants and their families; and
You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself, your child, or your family members (including, but not limited to, personal injury, disability or death), or any illness, damage, loss, claim, liability or expense (including medical bills, attorneys’ fees and court costs), of any kind, that you, your child, or your family members may experience or incur in connection with your child’s access to Prestige Dance Studio or Manchester High School buildings used by PDM Productions, Inc. or his/her participation in the Program provided by PDM Productions, Inc. (collectively, “Claims”); and
Student and his/her assignees, heirs, parents, guardians, and legal representatives hereby release, covenant not to sue, discharge and hold harmless PDM Productions, Inc., and its officers, directors, employees, faculty, staff, students, agents, representatives, affiliates, successors, and assigns (collectively “Releasees”) of and from all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or related to the Student’s or the Student’s family members’ or guardians’ access to Prestige Dance Studio or Manchester High School buildings or participation in the Program provided by PDM Productions, Inc., whether arising out of the negligent acts or omissions of any Releasee or otherwise, and whether any coronavirus infection or exposure occurs before, during or after access to the Prestige Dance Studio or Manchester High School buildings or participation in the Program provided by PDM Productions, Inc,; and
If our state issues a lockdown and stay-at-home orders in response to Covid between October 16th thru 31st, 50% of the Participation Fee will be refunded. If a lockdown is issued between November 6th thru 14th, 25% will be refunded. Afterwards, zero will be refunded.
You understand that by signing this release, you are voluntarily waiving any and all Claims, known and unknown, including those Claims that may be unknown to you, or which you do not suspect to exist at this time.
If any provision of this release is held to be unenforceable by a court of competent jurisdiction, then (a) this release shall be deemed to be amended to the extent necessary to render the otherwise unenforceable provision, and the rest of the release, valid and enforceable, or, alternatively (b) the invalidity or unenforceability of any provision of this release shall not affect the validity or enforceability of the remaining provisions, which shall be enforced as if the offending provision had not been included in this release. Releasees are third-party beneficiaries to this release and shall have the right to enforce it to the full extent permitted by law.
